DTAA India-UAE: Complete NRI Tax Guide 2026
What is the India-UAE DTAA?
The Double Taxation Avoidance Agreement (DTAA) between India and the United Arab Emirates is a bilateral tax treaty that ensures NRIs living and working in the UAE are not taxed twice on the same income — once in the UAE and once in India.
India and UAE signed their DTAA in 1993, and it covers income from salaries, business profits, dividends, interest, royalties, and capital gains.
Key Benefits of India-UAE DTAA for NRIs
- Salary income: UAE salary is not taxable in India if you qualify as an NRI (less than 182 days in India in a financial year)
- Interest on NRE accounts: Fully exempt from Indian tax regardless of DTAA
- Rental income from India: Taxable in India but DTAA provides relief to avoid double taxation
- Capital gains on Indian property: Taxable in India; DTAA provides credit mechanism in UAE
- Dividends from Indian companies: Subject to TDS in India; DTAA caps withholding rates
Who Qualifies as an NRI Under Indian Tax Law?
You are an NRI for a financial year if you spend fewer than 182 days in India during that year. From 2020, the threshold was amended — Indian citizens earning over ₹15 lakhs from Indian sources who spend 120–182 days in India may be deemed residents. UAE-based NRIs should track their India visits carefully.
How to Claim DTAA Benefits
- Obtain a Tax Residency Certificate (TRC) from the UAE Federal Tax Authority
- Submit Form 10F to your Indian bank or income payer
- Provide your PAN card details
- File your Indian income tax return (ITR-2 for NRIs) claiming DTAA relief
TDS on NRI Income — DTAA Impact
Without DTAA, TDS on NRI income from India can be as high as 30%. With a valid TRC and Form 10F, you can claim reduced TDS rates as per the treaty. For interest income, the DTAA caps TDS at 12.5%.
NRI Property Sale and DTAA
When an NRI sells property in Kerala or anywhere in India, TDS is deducted at 20% (long-term) or 30% (short-term) by the buyer. You can apply to the Income Tax Officer for a lower TDS certificate if your actual tax liability is lower due to DTAA benefits.
Common Mistakes UAE NRIs Make
- Not obtaining a TRC before the financial year ends
- Failing to file ITR in India assuming UAE income is not taxable
- Not tracking days spent in India — risking deemed residency
- Missing the lower TDS certificate application before property sale
